Crypto-Asset Risk Disclosure

Crypto India · Headkey Software Technologies Private Limited Effective date: 9 October 2026 · Version: 2026-10-09

Draft — needs review by a qualified lawyer before launch. This forms part of our Terms of Service.

Crypto-assets (called "virtual digital assets" or VDAs under Indian tax law) are high-risk. Read this before you use Crypto India, and only use money you can afford to lose.

1. Our regulatory status

Paper mode: trades are simulated; receiving, sending and buying real crypto are switched off until a regulated custodian is connected.

  • FIU-IND registration: [PLACEHOLDER: not registered / not connected yet — no number is claimed]
  • Custodian (when live): [PLACEHOLDER: not registered / not connected yet — no number is claimed]

Crypto India is not a bank, a stock exchange, a SEBI-registered investment adviser or a payment bank.

2. Crypto-assets are not legal tender and are largely unregulated

  • Crypto-assets are not legal tender in India and are not issued or backed by the Reserve Bank of India or any government.
  • They are not deposits. There is no deposit insurance (DICGC) and no investor-protection fund if something goes wrong.
  • Crypto-assets are not securities regulated by SEBI, so the protections that apply to shares and mutual funds do not apply.

3. You can lose some or all of your money

  • Prices are extremely volatile and can fall sharply in minutes, including to zero.
  • Past performance, charts, leaderboards and copy-trading results do not predict future results.
  • Some coins can be hard to sell quickly at a fair price (low liquidity), especially in a market crash.

4. Information in the app is not advice

Market data, exchange comparisons, AI insights and leaderboards are general information only. They can be delayed, incomplete or wrong (for example, reference prices shown as "delayed" when the live feed is down). They are not investment, tax or legal advice. Decide for yourself, and consider independent advice.

5. Paper trading vs real crypto

  • In paper mode, trades are simulated at the server's price. No real crypto or money moves, and paper profits are not real.
  • Real results can differ from paper results (fees, spreads, slippage and liquidity).

6. Real crypto: custody, transfers and security

  • When real crypto is enabled, it is held by the custodian named above under its own terms as well as ours. If the custodian or an exchange fails, is hacked or freezes withdrawals, you could lose your crypto.
  • Blockchain transfers are usually irreversible. Crypto sent to a wrong address or network normally cannot be recovered.
  • Keep your password and 2FA safe. We will never ask for your password, 2FA code or private keys.
  • Larger transfers need Travel Rule details (beneficiary name, wallet type and exchange) and may be delayed or refused for compliance checks.

7. Connected and third-party exchanges

Balances from exchanges you connect (read-only) and comparisons of other exchanges come from those providers. We do not control them and are not responsible for their prices, fees, outages or solvency.

8. Laws can change

Indian law and tax rules for crypto-assets are still developing. New rules could restrict, tax or ban some activities, and we may have to change or stop features at short notice.

9. Tax

  • Under current Indian tax law, income from transferring VDAs is generally taxed at 30% (plus surcharge and cess), losses generally cannot be set off against other income, and 1% TDS under Section 393(1) may apply on transfers.
  • TDS and Schedule VDA figures in the app are estimates (paper trades are estimates only). You are responsible for your own tax filings. Consult a tax adviser.
